Challenges to Collective Bargaining in the EU & United States

Background: Wisconsin ENDS Collective Bargaining on all
but wages for state and local employees. Some have completely lost rights to collective bargaining: Home health care workers paid by Medicaid; Family child care workers; University of Wisconsin Hospital and Clinic employees; University of Wisconsin faculty and academic staff.

The trend continues in the EU. An Employer’s Right to Freedom of Establishment may continue to limit collective bargaining of trade unions under the landmark Viking case decided by the European Court of Justice.
